    Here's the rub with cases being closed after citations are issued. The case is closed yet the fence is still an illegal fence. If not that then what we have here is build what you want, you may get cited, and if you do get cited you get to keep your illegal fence. Is the fence now legal merely because a citation was issued? Is the citation mysteriously transformed into a permit? Is it just me or is there something wrong here?

Here's the rub with cases beings closed after citations are issued. The case is closed yet the fence is still an illegal fence. If not that then what we have here is build what you want, you may get cited, and if you do get cited you get to keep your illegal fence. Is the fence now legal merely because a citation was issued? Is the citation mysteriously transformed into a permit? Is it just me or is there something wrong here? (The illegal carport conversion was handled the same way.)

UPDATE: 3/10/06 Associate talked to 311 re: status of No. 060036659 - was informed that it was reinspected on the 3/2/06 and a Notice of Violation was issued by Insp. Johnny Tellis and sent Certified Mail/Return Receipt on 3/3/06. Clerk had documented Notice on 3/7/06 and the case had been closed. (During the conversation I was told that on 2/9/06 pictures had been taken, notes reflected the fence is 8’ and “meets code” and no violation had been found. The case was closed at that time. This was followed by the notation on 2/18/06 of first inspection.)

2/24/06 Associate talked with Insp. Johnny Tellis regarding the question: At what height is a permit required for a fence? Tellis told me a year ago the law was changed and it could be up to 10 ft. in the back. It shouldn’t exceed 4 feet on the sides in the front. I thanked him for the information and called a local fence company. Owner said anything over 6 ft. required a permit and he wasn’t aware of any changes. I called Mr. Tellis back to clarify the information received earlier and he told me that a fence was considered a structure and you have to have a permit for it. Any fence put up has to have a permit - any new fence - regardless. He said this was really a building inspection question. [Is this the same Johnny Tellis on 2/9/06 stated that a permit IS NOT REQUIRED for an 8 foot fence and "meets code?"]

4:45pm, Feb. 21, 2006, follow up on #06-0036659 - 3-1-1 op reports on 2/9/06 Johnny Tellis finds "no violation found." 3-1-1 op said he can be reached at 214-670-6736 or cell 469-323-4149.

3:20pm, 2/7/06, Sandra Baxter with Department of Code Compliance called in "illegal fencing" #06-0036659.

10:30am, Friday, Jan. 27, 2006, called and talked with Inspector Rollie Blankenship (214-957-8288) regarding unpermited 8ft. fence at 2708 Hillglenn, #288-564, or #172-845. I read him the 3-1-1 info attributed to him ("there is no reason for a building permit and spoke with owner and owner told him he hadn't built anything in years.") and he stated, "I probably went to the wrong address." I asked if a permit was required for an 8ft fence. He stated that a permit was required. I mentioned that he had closed this (same address) out twice with the same reason. He said, "I probably went to the wrong on address on that, too." He had no information from my previous call of Jan. 4. It was as if this was the first time he had heard about this. (He did confirm he was retired but said he still answers his phone.)

8:50am, Wednesday, Jan. 4, 2006, spoke with Rollie Blankenship (214-957-8288) draws a blank and says he has nothing on 2708 Hillglenn, #288-564, or #172-845. He stated that I may have the wrong service numbers that 3-1-1 is really bad about giving out wrong numbers. (That 3-1-1 operators cannot be relied upon to do their jobs.) Blankenship wanted to know if I was the homeowner. He asked for our ph# and I said I'd call him back.

12:00pm, Dec. 30, 2005, Vernon at OneStopPermit 214-948-4480 states that a permit is required for a rear fence over 6 ft. (permit required for 8ft fence) and a variance for a fence over 8 ft. Vernon checks system for permit pulled on 2708 Hillglenn - no permit pulled. Vernon also checked entire block and no permits pulled.

3:58pm, Dec. 1, 2005 - 3-1-1 Belinda - "no violation found" - case closed Nov 14 (#288-564) Inspector Rollie Blankenship.

2:45pm, Oct. 5, 2005, 3-1-1 Audrey - inspected (#288-564) Sep 13 at 1:45pm no comments. Inspector Rollie Blankenship. Still open.

9:00am - Tuesday, Sep. 13, 2005, 3-1-1, Stormy confirmed Closed Out on #172-845 by Rollie Blankenship (214-957-8288) "there is no reason for a building permit and spoke with owner and owner told him he hadn't built anything in years." New service #288-564. Kathleen Davis 214-670-1855.

4:40pm, Aug, 15, 2005 - Mary 3-1-1 - #172-845 - Aug 15 Rollie Blankenship went out to 2708 Hillglenn Aug. 15 for fence and said "there is no reason for a building permit and spoke with owner and owner told him he hadn't built anything in years." [Yet there is a new 8ft fence in rear yard without benefit of a building permit.]

Fri. 1:20pm, Aug. 26, 2005 - called OneStopPermit 214-948-4480 - Melody states that a permit is required for a rear fence over 6ft and has no idea why Code Compliance would state otherwise.

July 30, 2005 - 3-1-1 Sandra op (Sherry) - June 18 Joe Lee was supposed to inspect - no notes or enter only "follow on activity created."

8:30am, Wed., June 8,2005 - 3-1-1 - Qualuceo, 8ft fence without permit #172-845.

8:19am - May 23, 2005 - OneStopPermit 214-948-4480 - Melody - no permit pulled for 8ft fence construction - permit required for fence over 6ft in rear yard and variance via Board of Adjustment over 10ft.
